TERMS AND CONDITIONS
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PLACING AN ORDER. BY CHECKING THE 'I AGREE' BOX AND SUBMITTING YOUR ORDER, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.
1. Services Provided
Simply Drafting, Inc. provides Computer-Aided Drafting (CAD) services only. We do not provide engineering, architectural, structural, mechanical, electrical, or any other professional design services. All drafting is performed solely in accordance with the specifications, dimensions, and information provided by the Customer. We do not independently verify, certify, or stamp any drawings.
2. Customer Responsibility for Accuracy of Information
You, the Customer, represent and warrant that all information, dimensions, specifications, and instructions you provide to us are accurate, complete, and sufficient for the requested drafting work. You assume full and sole responsibility for any errors, omissions, or inaccuracies in the information you supply. We are not responsible for any defects, errors, or problems in the completed drawings that result from inaccurate, incomplete, or ambiguous information provided by you.
3. No Professional or Licensed Services
The drafting services provided by the Company do not constitute and shall not be construed as the practice of engineering, architecture, land surveying, or any other licensed profession. Completed drawings are not stamped, certified, or approved by any licensed professional. It is your sole responsibility to obtain any required professional review, stamp, permit approval, or regulatory compliance verification before using any drawings for construction, permitting, or any other purpose.
4. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Company provides all services and deliverables "as is" and "as directed." We make no warranties, express or implied, including but not limited to any implied warranty of merchantability, fitness for a particular purpose, or suitability for permitting, construction, or regulatory approval.
5. Limitation of Liability
To the fullest extent permitted by applicable law:
(a) The Company's total liability to you for any claim arising out of or related to these Terms or the services provided shall not exceed the total amount you paid for the specific order giving rise to the claim.
(b) In no event shall the Company be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of profits, loss of use, cost of substitute services, or any damages arising from the use or inability to use the completed drawings, even if the Company has been advised of the possibility of such damages.
(c) This limitation of liability applies regardless of the theory of liability, whether in contract, tort, negligence, strict liability, or otherwise.
6. Indemnification
You agree to defend, indemnify, and hold harmless the Company and its owner(s) from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
(a) Your use of the completed drawings;
(b) Any inaccuracy or insufficiency in the information you provided;
(c) Your failure to obtain required professional review, permits, or approvals; or
(d) Any third-party claims arising from the construction, use, or implementation of any project based on the drawings.
7. Intellectual Property
Upon receipt of full payment, you are granted a non-exclusive license to use the completed drawings for the purposes described in your order. The Company retains the right to retain copies of completed work for portfolio and business records purposes, subject to any confidentiality obligations. You may not resell or redistribute the drawings as drafting templates or products without prior written consent.
8. Revisions and Scope of Work
The scope of drafting services is limited to the specifications submitted at the time of order. Any revisions requested after order submission that fall outside the original scope may be subject to additional charges. Revisions resulting from errors in the information you provided are not covered under any revision policy and will be billed separately.
9. No Guarantee of Permit or Regulatory Approval
The Company makes no representation or guarantee that any completed drawings will be approved by any governmental authority, building department, or regulatory body. Permitting requirements vary by jurisdiction and are your sole responsibility to determine and satisfy.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles. Any dispute arising out of or related to these Terms or the services provided shall be resolved by binding arbitration administered under the rules of the American Arbitration Association, with proceedings conducted in [County], Illinois. You waive any right to a jury trial or to participate in a class action.
11. Entire Agreement
These Terms constitute the entire agreement between you and the Company with respect to the subject matter hereof and supersede all prior agreements, representations, or understandings. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
12. Acceptance
BY CHECKING THE 'I AGREE' BOX AND SUBMITTING YOUR ORDER, YOU CONFIRM THAT YOU HAVE READ AND AGREE TO THESE TERMS AND CONDITIONS IN THEIR ENTIRETY.
